Version: 01/2026 — Deutsch ist maßgeblich; English is provided for convenience.
0. Provider, Contact, Business Hours
Provider/Merchant: Co-Victory GmbH, Nestroyplatz 1/3/32, 1020 Vienna, Austria. Email: office@co-victory.com. Company register: FN 630724k. VAT ID: ATU80933402. Business hours: Mon–Fri 09:00–17:00 (Vienna time). Outside business hours: contact via email/SMS/WhatsApp; Co-Victory will respond as soon as reasonably possible. If a tour leader/guide has been assigned, please contact them as well. These terms apply to consumers (B2C). If the customer qualifies as a business, Section M (B2B fallback) applies in addition.
1. Definitions and Contract Structure
Co-Victory primarily provides single travel services (e.g., accommodation, transfers, rental car intermediation, activities/events, wellness/ski services) and optional add-ons. Co-Victory expressly does not intend to offer 'package travel' or 'linked travel arrangements' within the meaning of Austrian package travel rules. Where possible, services are contracted, confirmed, and invoiced separately. If a combination of services is nevertheless legally classified as a package or linked travel arrangement, mandatory law prevails. The signed offer/contract ('Travel Offer') prevails. These terms supplement the Travel Offer.
2. Offer, Contract Formation, Form
Offers are typically provided by email and are only valid for a short time due to fluctuating availability and pricing. Future pricing cannot be guaranteed. A contract is formed only upon Co-Victory's express written acceptance/confirmation (e.g., by email, scanned signature, digital signature, DocuSign). Prior communications do not constitute acceptance. The customer confirms that all provided information (names as in travel documents, contact details, special requests, mobility/health needs) is accurate and complete. Co-Victory acts as the travel organizer/provider under these terms unless the offer explicitly states otherwise.
3. Communication, Delivery, Documentation Duties
Co-Victory communicates primarily by email; phone, SMS, WhatsApp or other digital chat services may be used as supplementary channels. Routine notices are deemed received if sent to the last email address provided and not returned as undeliverable. Critical notices (in particular price changes, material changes, cancellations, deadlines) will also be sent via SMS/chat to the last number/account provided. The customer must review all documents and deadlines and promptly notify Co-Victory of any discrepancies.
4. Curation and Concept Fee
Co-Victory provides individualized curation, planning and organizational services (needs assessment, itinerary design, supplier selection, availability and pricing checks, reservation management, creation/adaptation of a personalized travel plan, ongoing coordination). The Curation Fee accrues upon acceptance/signature of the offer or written engagement and is due immediately unless stated otherwise in the offer. Unless otherwise stated, the Curation Fee is at least 30% of the total price. If the customer terminates/withdraws after the Curation Fee has accrued, it is generally non-refundable because the personalized service has been/will be performed. Mandatory law remains unaffected.
5. Prices, Taxes, Currency, Fees
Prices are in EUR unless explicitly stated otherwise. If the customer selects a conversion option during payment (e.g., via a payment provider), conversion is solely the customer's responsibility; exchange rate, conversion fees and bank charges are borne by the customer. All payment processing fees (card/Stripe fees, bank charges, returned direct debit fees, chargeback fees) are borne by the customer to the extent permitted by law. Co-Victory may adjust prices if taxes/charges/fees change, the customer requests material itinerary changes, or there is a significant delay between the offer and acceptance.
6. Payment Terms
Payment methods: credit card, Stripe payment link, wire transfer, direct debit, if offered. Due dates: If travel begins more than 6 months in the future: 20% upon signature; 80% three months before travel start. If travel begins within 3 months: 100% immediately. In case of default, Co-Victory may charge reminder fees and default interest and, after granting a reasonable cure period, terminate the contract and/or cancel services. Where mandatory law (e.g., package travel rules) requires different payment terms, such mandatory rules prevail.
7. Travel Documents
After full payment, Co-Victory typically issues a travel confirmation within one week. Vouchers, hotel/rental car documents, activity tickets and itinerary are typically provided 1–2 weeks before departure, subject to timely delivery by suppliers. The customer must check all documents upon receipt (names, dates, times).
8. Cancellation, Changes, No-Show
General rule: Travel/services are generally non-cancellable unless the Travel Offer explicitly includes a cancellation option or mandatory law provides otherwise. Cancellation option: If selected in the Travel Offer, the customer may, for a surcharge of 20% of the travel price, cancel up to 48 hours before arrival and receive a refund of 90% of the travel price. Excluded are individualized experiences/services created specifically for the customer (non-cancellable). Payment/bank fees will be deducted from any refund. No-show: If the customer fails to show up without notice, Co-Victory may charge 100% as a cancellation fee. If the customer reports changes at least 24 hours before travel start, Co-Victory will, where possible, attempt to reschedule/adapt; supplier surcharges may be passed through.
9. Replacement Traveler / Transfer
The customer may nominate a replacement traveler up to 5 days before departure, provided suppliers permit and there are no legal/operational impediments. A transfer fee of EUR 100 to EUR 400 plus tax per person applies; supplier fees (e.g., name change) may also apply.
10. Changes/Cancellation by Co-Victory; Extraordinary Circumstances; Weather
Co-Victory may adjust services if required for organizational reasons, due to availability, or due to unavoidable extraordinary circumstances (e.g., severe weather, strikes, governmental measures). Co-Victory will inform the customer of material changes (significant hotel change, major program changes, substantial time shifts). The customer must respond within a reasonable period. Program items may be cancelled or rescheduled for safety or weather reasons. Where possible, alternatives will be offered; no entitlement to equivalence. If a service is objectively impossible and no reasonable substitute is available, Co-Victory may cancel the affected components; only the non-performable components will be refunded.
11. Customer Duties (Travel Documents, Cooperation, Safety)
The customer is responsible for passport validity, visas, entry and health requirements and any required vaccinations/tests. The customer must arrive on time for check-ins, transfers, and meeting points. Special requests and any mobility/health needs must be disclosed in writing before booking. For skiing and other activities, the customer must follow safety instructions and supplier terms and verify adequate insurance coverage.
12. Defects, Remedy, Complaints
Defects must be reported promptly on site (no later than 24 hours after becoming aware) so that Co-Victory can provide a remedy. Reports may be made by email, phone, or in person via the tour leader/guide. The customer is requested to document any complaints in writing within 3 days after the end of travel and provide evidence. This is not a forfeiture deadline; it serves speedy resolution.
13. Liability
To the extent permitted by law, Co-Victory is liable only for intent and gross negligence. Liability for personal injury and mandatory liability remains unaffected. For third-party services (hotels, activity providers, rental car companies, transport companies, guides), Co-Victory is liable only within the scope of statutory selection/organizational duties; otherwise the supplier is responsible. No liability for lost profit, consequential or indirect damages to the extent permitted by law.
14. Accessibility/Mobility
The customer must disclose any mobility or assistance needs in writing before booking. Co-Victory will use reasonable efforts to arrange suitable services but does not guarantee full accessibility or suitability where information is incomplete or suppliers have limitations. Supplier requirements (e.g., fitness, minimum age, medical suitability) are binding.
15. Insurance & Insurance Intermediation
Co-Victory intermediates/sells an optional travel health insurance and travel liability insurance at EUR 27 per person per day. The insurance terms in the annex apply (version 01/2026); subject to change without warranty. Co-Victory does not provide travel cancellation insurance. The customer should obtain such coverage locally in their home jurisdiction. Co-Victory does not grant coverage confirmations and does not provide legal advice. Coverage decisions and benefits are handled solely by the insurer.
16. Chargebacks, Returned Payments, Collections
The customer agrees to contact Co-Victory first in case of questions/disputes and allow a reasonable opportunity to resolve. Chargebacks may only be initiated for genuinely unauthorized payments or demonstrably non-performed services. In case of unjustified chargebacks/returned payments, Co-Victory may pass on all fees/charges and additionally charge an administrative fee of EUR 250 net per case. Co-Victory may suspend services while a payment dispute is unresolved.
17. Data Protection, Third Parties, Recordings
Co-Victory processes personal data for contract performance and communication. Details are set out in the privacy policy. Systems used may include Stripe, DocuSign, Close.io (CRM), WhatsApp Business, Zoom (including transcripts), Cal.eu, Microsoft OneDrive, Bokun, cPanel, and Hostinger. Zoom meetings may be transcribed for documentation; the customer may object in advance.
18. Minors
Contracting parties must generally be of legal age (18+). Exceptionally, bookings by persons aged 16+ may be accepted if written parental authorization is provided and Co-Victory agrees. Co-Victory may request adequate proof.
19. Alternative Dispute Resolution
Co-Victory is generally willing to participate in out-of-court dispute resolution. Details and any competent bodies/processes will be provided upon request. Participation is mandatory only if required by applicable law.
20. Governing Law, Jurisdiction, Language
Austrian law applies, excluding conflict-of-laws rules and, where applicable, excluding the CISG. The competent venue is Vienna, Austria, to the extent permitted. The German version is authoritative; the English text is for convenience only. Mandatory consumer rights remain unaffected.
M. B2B Fallback (Business Customer Terms)
A customer is a business if acting in the course of trade, in particular where company details/VAT ID are provided, the booking is for employees, or the circumstances clearly indicate a business purpose. In B2B cases, no cancellation option is offered; cancellations/changes are governed by the offer and actual supplier costs. In B2B, Co-Victory is liable only for intent and gross negligence to the extent permitted by law; lost profit, consequential and indirect damages are excluded. Set-off and retention rights are excluded. Any customer purchasing terms/conditions are rejected. Invoicing depends on place of supply/tax classification (incl. reverse charge or third-country rules). Exclusive venue for businesses is Vienna, Austria. German is authoritative.
